THIS AGREEMENT IS A LEGAL CONTRACT BETWEEN YOU (“USER”) AND ISWAP (SMC PRIVATE) LIMITED. OR THE APPLICABLE AFFILIATIONS, SERVICES AND COMMERCIAL OFFERINGS OF ISWAP (SMC PRIVATE) LIMITED. DOING BUSINESS AS “ISWAP (SMC PRIVATE) LIMITED” (“COMPANY,” “WE,” “OUR,” OR “US”).
By accessing our website, services through any mean assosiated or bonded to these term & conditions, accessing or using any content, information, services, features or resources available or enabled by iSwap (SMC Private) Limited, or clicking on a link or doing an action to signify your acceptance of this Agreement, you:
(1) agree to be bound by this Agreement and any future amendments and additions to this Agreement as published through the website, services.
(2) agree and verify that you are of legal age in your jurisdiction of residence, city and country to form a binding contract with iSwap (SMC Private Limited ).
(3) agree and accept that you have the authority to enter into this Agreement Individually and, if required, on behalf of any third party, company or organization or other legal entity on whose behalf you may access or use our services. Except as otherwise provided herein, if you do not agree to be bound by this Agreement you may not access or use the Services.
Your (“USER”) use of our services on this website or any other organizations owned by or parent association with iSwap (SMC Private) Limited is subject to additional terms including but not limited to; Privacy Policy, Repair Rules & Regulations, Copyright Policy, and Payments & Refunds which are enforced with reference to this agreement and you (“USER”) agree to all additional terms by using our platform.
Service Description:
We provides professional mobile repair services which are booked through our website (iSwap.com.pk) by calling us, through Whatsapp, by email or visiting us at our registered branches. Our services include doorstep mobile repairs, diagnostics, hardware replacements, and software troubleshooting for various smartphone brands and models with FREE Door to Door Pickup and Deliver.
We strive and work hard to offer high-quality repairs using genuine spare parts, replacements and fixes performed by certified technicians. Our goal is to deliver convenient, affordable, and efficient mobile repair solutions to ensure customer satisfaction.
By using our services, you acknowledge that repairs may involve handling sensitive components and agree to the Repairing Rules and Regulations before booking any of the services offered on our platform.
User Eligibility & Conduct:
By using of our services you (“USER”) agree to:
(1) not use our platform if you are below the legal age of (18) or you do not have a legal guardian present while accessing or booking our services.
(2) not use multiple identities to represent yourself while using our platform or misusing the identity of any other person which includes but not limited to, Name, Mobile Number, Email Address, or any legal identity document in the jurisdiction of the place of your locality or country.
(3) not ask for any illegel activity or service from any staff member of iSwap (SMC Private) Limited which involves a crime or misconduct of any service or law of your local jurisdiction. Only you (“USER”) will be responsible of any act and we do not take any responsibilty on our part.
(4) not provide any illegel device for any servies booked which includes but not limited to; Stolen or Lost Devices, Counterfeit or Cloned Phones, IMEI-Tampered Devices, Smuggled or Unregistered Phones, Malware-Embedded Phones, Network-Locked or Unauthorized Carrier-Unlocked Phones, Modified or Jailbroken/Rooted Phones.
(5) comply with necessary instructions and guidence given by the staff of iSwap (SMC Private) Limited.
(6) treat our staff with respect and professionalism. Any form of abuse, harassment, or inappropriate behavior toward our technicians or customer service representatives will not be tolerated and may result in service denial or legal action.
(7) Misuse of our services, fraudulent claims, or inappropriate behavior may result in service termination.
(8) not offer bribes, gifts, or personal favors to our staff in exchange for preferential treatment, discounts, or unauthorized services. Any such attempts may lead to service refusal and potential legal action
Pickup & Delivery:
FREE Pick and Delivery is offered and later scheduled only when you (“USER”) have booked a service through any booking chanel which includes but not limited to; Book Your Repair Page on our website, Calling On Registered Mobile, Registered Landline, Sending us email on Registered Emails, only upon availibilty and verifying the pickup location.
By using of our services you (“USER”) agree:
(1) that (“WE”) can refuse Pick up and Delivery service at any time of the day, month or year if we want to.
(2) that (“WE”) can refuse Pick up and Delivery service if you (“USER”) are not answering the call, email, Whatsapp or you are not in the area of operations or you have cancelled your order or booking more than (3) times on single identity, Mobile, Email or Address.
(3) that a Pickup and Delivery fee will be charged according to your area of locality if you have not followed the clause (2) of Pickup & Delivery.
(4) to not hand over any device booked for repairing service from (“US”) which include but no limited to; Mobile Phone repair, Tablet Repair to any unauthorized person, shop or business representing as our associates or affiliated partners until unless notified.
(5) to not hand over the device which does not match the description, model, brand or fault mentioned during the booking.
(6) that (“WE”) can refuse services to you (“USER”) if we found any of the issue which is mentions in the clause (4) of User Eligibilty & Conduct and may take a legal action.
(7) to must seal the device by your self in the given flyer after the inspection by our pick up associate and take the Repair Agreement and Consent form duly signed and stamped by both parties (“USER”) and (“WE”), each party will have ony copy of that agreement.
(8) to always check the Name, National ID Card Original, Mobile Number by calling, mentioned in the booking email sent to you on your given email, Whatsapp from our registered email and mobile number.
(9) to be on the location on the given date and time booked for the delivery of your repaired, diagnosed, or returned and refused device while attempted delivery.
(10) that (“WE”) can refuse the delivery to your address if we fail to deliver due to (“USER”) mistake on (01) attempt of delivery after several calling attempts and Messages on Whatsapp. In this case you can collect the device from our registered office or meet our delivery associate in person if they are available.
(11) to check the device on the time of delivery, do not accept the delivery if flyer is open, seal is not available or teared or broken or damaged.
(12) to check the device on the spot if issue is fixed you can sign the Delivery Note and keep the device. If the issue is not fixed you can take a new flyer, seal the device and send it back. NOTE NO DELIVERY NOTE WILL BE SIGNED WHEN THE DEVICE IS RETURNED.
(13) that once the device is delivered after proper checking by (“USER”) on the time of delivery, there will not be any warranty or guarantee which can be claimed by the (“USER”).
(14) that once the device is delivered and delivery note is signed, any new issue from the device will be fixed with a new booking and agreed charges.
Violations:
In the event of any violation to any statement, agreement, consent or misconduct (“WE”) shall have the right to terminate our service to you and may refuse to provide you services in the future through any platfrom of our organization and permanently block you from using our services by blacklisting you in our records.
Law & jurisdiction:
This agreement is subject to the laws of Pakistan and will be interpreted accordingly. By using our services, you agree that any disputes or legal matters will fall under the exclusive jurisdiction of the courts in Lahore, Pakistan. However, iSwap retains the right to take legal action in any relevant jurisdiction to protect and enforce its rights.
Acceptance of Changes:
By continuing to use our services, you acknowledge and agree that all new changes to this contract, statements or agreements of iSwap (SMC Private) Limited, including but not limited to; Privacy Policy, Repair Rules and Regulations are bonded and legally imposed on all users, third parties representing any other legal body. I also agree that any new changes to any of those agreements will be effective as posted.
Disputes, Questions & Complaints:
(1) We aim to resolve all disputes amicably through negotiation. Customers are encouraged to contact our customer support team to discuss any concerns. at info@iswap.com.pk or call at 053-2197304
(2) If a dispute remains unresolved, both parties may seek mediation or arbitration as a means of resolution before taking legal action.
(3) Any legal disputes shall be governed by and interpreted under the laws of Pakistan, and the courts of Pakistan shall have exclusive jurisdiction.
(4) You (“USER”) agree not to engage in public defamation, including posting misleading or false statements online, before attempting formal dispute resolution with us.
